MR. ZAPPOLO explaining to THE COURT that Mosler’s mid-trial attempt to have the $110million Breach of Contract taken away from the Jury was legally improper.
THE COURT had heard both attorneys, now is “reading” the simple 2-page Contract. During the 11-years leading up to Trial, Defendants had tried to get eliminated multiple times [unsuccessfully] while honest Judge Hafele was presiding.
After THE COURT stripped the $110million Breach of Contract (Count III) away from the Jury, MR. ZAPPOLO illustrated again that the contract itself states that if MACC doesn’t build cars for SEI, SEI cannot lose it’s contractual rights. Judge Delgado responds, “Okay. [billionaire still wins]”
Continuing on [around 7pm at end of the same day as Wagner’s cross-examination]; Judge Delgado [THE COURT] now stripped away from the Jury the 2nd $100million+ Count: Defamation with PUNITIVE DAMAGES Count IX.
NOTE: Plaintiffs had shown very clearly that Warren Mosler’s defamation (that continued for a full year) was DESIGNED WITH A PROFIT MOTIVE to beat Wagner bloody (financially ruin him), so that Wagner would surrender his:
- Intellectual Property: 838hp RaptorGTR powertrain invention
- Exclusive Distributorships in China, Thailand, Saudi Arabia, and United Arab Emirates
- Wagner’s $100,000 deposit that he had put down BEFORE RaptorGTR passed EPA Certification
- Give Warren Mosler a full release (so Wagner couldn’t sure Mosler for defamation).
